I believe the 1940 census is key to determining Juan's parentage. Juan is listed as living in the rear of the same property and residence of Emilio Hernandez, who is presumed to be the father of Juan. This is corroborated by the 1930 federal census where Juan is listed as a son of Emilio and Andrea Hernandez (Step-mother). He was listed as age 23 which would place his birth at about 1907, in Mexico. Many age descrepancies among the family exist, but I believe it is inherent in some records; where many families of Mexican descent lived/traveled in both the United States and Mexico. I believe some of this family may have been split between Mexico and Texas during these 1930 and 1940 census timeframes. Despite the many descrepancies, as for Juan Hernandez, the info indicated above is my basis for listing Emilio as the father of Juan Hernandez. Birth day Descepancy: California Death records indicate Juan was born on 24 Jun 1908 in Mexico and died 19 July 1971 in Santa Clara County, California. This is interesting, because we know in 1860, he was listed as having wife Jane Warren. Like many Warren ancestors; perhaps he wanted to serve in the War; and just happened to forget he was not married when applying.
