- Article of agreement entered into this 13th day of August 1807 betweenCharles Powell Senior of the county of Mercer of the one partand Jer.Briscoe of the county the other part witnesseth that whereassome unhappydifferences has taken place between me Charles Powell andmy wife SarahPowell which is the cause of her seeking protectionamongst her childrenand her neighbors and in order that our disputesmay come to a finalissue and all matters adjusted between us andbelieving it to be a duty Iowe to my wife as she has equally withmyself bore the heat of the day inprocuring the title property we nowpossess which she has not only theright to claim from her servicesrendered but from her possessing aconsiderable part when sheintermarried with me and as she is now faradvanced in years and veryinfirm and wishing her welfare and also tomanifest to the world myupright intentions and in order that she may bewell provided for. Icovenant and agree and by those present do bindmyself and heirs in thepenal sum of six hundred pounds to deliver toJeremiah Briscoe and tosecure the same by a proper bill of sale fiveNegroes, to wit, Lid, ablack woman 27 years old and Tony, Jeff, Jordain,and Mirah, childrenof said black woman except Tony, also the one half ofmy stock ofcattle, sheep and hogs and the whole of the kitchenfurniture, twentybarrels of indian corn to be paid next fall. Also oneroan mare and twoyearling colts, each bridled with a stirrup cross? ,also one featherbed which she now has in her possession, all and everyspecies of theaforesaid property. I do bind myself to warrant toaforesaid JeremiahBriscoe and his heirs and for and in consideration ofthe said propertythe said Briscoe doth bind himself in the penal sum ofsix hundredpounds to pay to Sarah Powell the lawful interest due yearlyon the sumof one thousand dollars and the sum of ten dollars part oftheprincipal and what ever shall remain of the principal at the deathofSarah Powell to be paid to any person or persons she may bywillauthorize to receive it in eighteen months after her death withlawfulinterest due therein and if it should so happen that the saidSarahPowell should fail to bequeath her money the above way, in thatcase, theaforesaid Jer. Briscoe is bound to pay the aforesaid sum tothe heirs ofCharles Powell Senior in an equal proportion and in thesame time asabove named and in order that this instrument of writingmay be fullyunderstood it is expressedly named and agreed by CharlesPowell Seniorand Sarah his wife that the money be paid in differentpayments to bemade in the lifetime of the said Sarah Powell is for herbenefit and tobe paid to her and her only and no other person as longas she lives andafterwards in the manner above named and all receiptsgiven by her andproperly attested shall be credited but all frauds insaid receiptsliable to detection if any should happen. It is alsounderstood byCharles Powell and Sarah Powell his wife that the sum bepaid to theSarah Powell by the aforesaid Jeremiah Briscoe inconstituted of all herdower and as full compensation from CharlesPowell to his wife SarahPowell and she does release the said Powellfrom every obligation he isunder to her as a husband.
