Gough vs. Skaggs
Shadrac Skaggs states that sometime in 1794, he purchased a horse of William Goff. At the time
of purchasing the horse, Goff said the horse was sound and free from disease. Goff knew the horse
was infected with a fatal distemper of which he shortly died. Skaggs gave Goff two separate bonds,
one for diree cows and calves and die other for two cows and calves. He instituted two suits in Green
County Quarter Sessions Court.
William Gough, alias Goff, states that on the last day of July, 1794, he sold a horse for five cows.
Goff had bought the horse three days before as a sound horse. He told Skaggs to look at him and take
him if he wanted and as far as he knew, the horse was sound. Skaggs took the saddle off and looked
the horse over and agreed to take him. The horse was sound at that time. Skaggs had the horse for two
weeks when Goff saw him at court and he didn't mention the horse being sick.
